My neighbour's water leak or nuisance is damaging my home in Malaysia. What can I do?

Updated · Bahasa Malaysia · 中文

Key points

  • Strata leaks: notify the JMB or MC in writing; there is a specific inspection procedure.
  • The Strata Management Tribunal hears listed claims not exceeding RM250,000.
  • Landed homes: claims are usually in nuisance or negligence.
  • Document the damage, cause and costs before repairs.
  • Try a written request first; escalate if there is no response.

A ceiling stain that keeps spreading, water dripping onto your bed, mould in the bathroom, constant drilling at night, or smoke from a neighbour's activities: neighbour disputes can make home life miserable and cause real financial loss.

Is your property strata or landed?

The route depends on the type of property.

  • Strata properties (condominiums, apartments, many townhouses and some gated developments) are governed by the Strata Management Act 2013 and its regulations, and managed by a Joint Management Body (JMB) or Management Corporation (MC).
  • Landed properties without strata title are governed by the general law of nuisance and negligence, and by local authority rules.

How are inter-floor leaks handled in strata buildings?

The Strata Management (Maintenance and Management) Regulations 2015 set out a specific procedure for inter-floor leakage. In summary:

  1. Notify the JMB or MC in writing, describing the leak and when it started.
  2. The management body arranges an inspection to determine the cause and which parcel or common property is responsible.
  3. The responsible party is then expected to repair within the time required. If the cause is in common property, the management body is generally responsible.

Keep copies of every notice and reply. If the issue is not resolved, the dispute may go to the tribunal.

What is the Strata Management Tribunal?

According to the Ministry of Local Government Development (KPKT), the Strata Management Tribunal is an alternative forum for strata management disputes. Owners, purchasers, developers, JMBs, MCs and management agents may file claims listed in the Fourth Schedule of the Act, for claims not exceeding RM250,000. It is generally quicker and less formal than court.

What about landed homes and other nuisances?

For landed properties, or nuisances not covered by strata rules:

  • Private nuisance: a substantial and unreasonable interference with your use and enjoyment of land, such as persistent water seepage, tree roots, noise or smoke.
  • Negligence: for example, a neighbour's renovation damages your wall.
  • Remedies may include damages for repair costs and loss, and an injunction to stop the nuisance.
  • Smaller money claims may be suitable for the small claims procedure if you meet the requirements.
  • Some issues, such as illegal renovations or noise, can also be reported to the local authority (municipal council).

What evidence should I collect?

  • Dated photos and videos showing the damage and how it progresses.
  • Moisture readings or a contractor's or surveyor's report on the cause.
  • Repair quotations and receipts.
  • Copies of notices to the neighbour and management body.
  • A diary of noise or nuisance incidents, with times.

Common mistakes

  • Repairing everything before documenting the damage and cause.
  • Entering the neighbour's unit without permission.
  • Withholding maintenance charges in protest. That can create a separate claim against you.
  • Posting angry accusations in residents' WhatsApp groups, which can lead to defamation issues.

Frequently asked questions

The JMB says it is the upper unit's problem, and the upper unit says it is common pipes. What now?

Ask for the inspection findings in writing. If the dispute continues, the tribunal can decide.

Can I claim for damaged furniture and alternative accommodation?

Reasonable losses caused by the leak may be claimable, with evidence.

Do I need a lawyer at the Strata Management Tribunal?

The tribunal is designed to be accessible, but advice can help with complex claims.

Can I stop paying maintenance fees until the leak is fixed?

Generally no. Withholding payment can expose you to recovery action.

My neighbour's renovation cracked my wall. Who do I claim against?

Possibly both the neighbour and the contractor. Gather evidence of the cause and timing.
