An action begins by writ of summons or, where the dispute is principally on points of law, by originating summons. Pleadings are exchanged (statement of claim, defence, reply); evidence is filed by witness statement and bundle of documents; trial proceeds by examination-in-chief, cross-examination and re-examination of witnesses. Court-annexed mediation is now common in the Sessions Court.

I have a commercial dispute with a Johor-based company. Where is the case heard?

Generally where the cause of action arose or where the defendant resides. For Johor-based defendants, the High Court Johor Bahru. The firm appears regularly in JB.

What is the limitation period?

Six years for most contract and tort claims under the Limitation Act 1953. One year for defamation. Specific shorter periods apply for some causes of action.

Do I need to mediate first?

Court-annexed mediation is increasingly directed at case-management, particularly in the Sessions Court. Pre-action mediation is voluntary.

How long does a civil case take?

18–30 months from filing to judgment is typical for Sessions / High Court matters. Complex commercial cases can run longer if multiple parties or substantial evidence are involved.

Can I claim my legal costs back?
