A defamatory post can travel further in twenty-four hours than a defamatory article in a national newspaper used to travel in a year. Facebook posts, Instagram stories, TikTok videos, X (formerly Twitter) threads, WhatsApp group messages, and Google reviews reach audiences instantly and persist indefinitely. Malaysian law treats online defamation as actionable on the same principles as traditional defamation, but the practical work of identifying the defamer, securing takedown, and quantifying damages is distinctive. This guide explains how online defamation claims are pursued in Malaysia.<\/p>\n

The Legal Framework<\/h2>\n

Online defamation engages multiple Malaysian statutes simultaneously. The Defamation Act 1957 and the common law govern the civil claim — the action for damages and injunctive relief brought by the defamed person against the defamer. Section 233 of the Communications and Multimedia Act 1998 criminalises offensive online communications and is the principal provision invoked in police complaints. The Penal Code criminal defamation provisions (sections 499 to 502) remain on the statute book, although they are rarely invoked in practice.<\/p>\n

What Is Defamatory Online?<\/h2>\n

The test for defamation is the same online as offline: a statement is defamatory if it lowers the claimant in the estimation of right-thinking members of society generally, or causes them to be shunned or avoided, or exposes them to hatred, contempt, or ridicule. The medium does not matter — a Facebook post, an Instagram caption, a tweet, a Google review, a WhatsApp message, even a blog comment can defame. The fact that a statement is short, casual, or written in informal language does not exclude it from the law.<\/p>\n

Libel vs Slander Online<\/h2>\n

The Defamation Act 1957 distinguishes libel (defamation in a permanent form) from slander (defamation in a transitory form). Online posts are almost universally treated as libel because they are written and persist. Libel is actionable per se — the claimant need not prove special damage. This is a significant advantage over slander, where damage must be pleaded and proved except for narrow exceptions in section 5 of the Act.<\/p>\n

Identifying the Defamer<\/h2>\n

The first practical challenge in many online defamation cases is identifying the defamer. Anonymous accounts, fake names, and burner profiles are increasingly common. Malaysian law provides a route through the Norwich Pharmacal jurisdiction, recognised in First Malaysia Finance Bhd v Dato’ Mohd Fathi Haji Ahmad<\/em> [1993] 2 MLJ 497. The claimant applies ex parte by Originating Summons in the High Court for an order compelling a third party — typically the platform operator (Meta, X, Google) and, subsequently, the local internet service provider — to disclose the identity of the unknown defendant. Most major platforms maintain Malaysia-facing legal portals and respond to High Court orders within fourteen to thirty days.<\/p>\n

Takedown Procedures<\/h2>\n

Removing the defamatory content quickly is often the claimant’s primary objective. There are three takedown routes that can be pursued in parallel. First, direct platform reporting under the platform’s community standards — Facebook, Instagram, TikTok, and X all have in-app reporting tools. Second, a complaint to the Malaysian Communications and Multimedia Commission under section 263 of the CMA 1998, which can direct Malaysian internet service providers to block access to non-compliant content. Third, a court order — an interim injunction restraining further publication and ordering takedown — obtained from the High Court on an urgent basis.<\/p>\n

Damages — The Trend in Malaysian Awards<\/h2>\n

Damages in online defamation cases in Malaysia have been on an upward trajectory. The function of damages was authoritatively stated by the Federal Court in MGG Pillai v Tan Sri Vincent Tan Chee Yioun<\/em> [2002] 2 MLJ 673: to vindicate reputation, console the claimant, and act as a deterrent. Awards in serious cases — sustained, malicious, widely-shared online defamation — have reached six figures and occasionally seven. Smaller cases, with limited reach and short duration, typically attract awards in the RM30,000 to RM80,000 range. Courts will consider the reach of the publication (number of views, shares, comments), the persistence of the content, the malice of the defamer, and the actual damage to the claimant’s reputation.<\/p>\n

Defences the Defamer Will Raise<\/h2>\n

The principal defences are justification (the statement is true), fair comment on a matter of public interest, qualified privilege (a duty or interest in making the communication to a recipient with a corresponding interest in receiving it), and the Reynolds defence of responsible journalism (rarely applicable in personal cases). A claimant should anticipate these defences during pre-litigation strategy and gather evidence that pre-empts them.<\/p>\n

What to Do If You Are Being Defamed Online<\/h2>\n

Six steps. First, preserve the defamatory content immediately — full-page screenshots showing the URL, timestamp, and surrounding context, plus screen recordings if the content is video. Second, do not engage with the defamer beyond a single clear request to stop, in writing, and preserve that exchange. Third, report the content under the platform’s community standards. Fourth, file a complaint with the MCMC via the Aduan portal. Fifth, lodge a police report under section 233 of the CMA 1998 if the content is sufficiently serious.
